Prakas 109 Procedure of Reviewing and Certification on Architectural and Structural Plan

  1. This Prakas sets out the procedures for reviewing and certifying plans for the purpose of implementing Sub-Decree No. 225 dated December 30, 2020 on the conditions and procedures of construction inspection and certification.
  2. Project reviewing and certification: refers to the reviewing, analysis, verification and certification of conformity of construction technical regulations and other applicable regulations of the design plan, calculation, technical instructions for new construction work, repairing work, demolition work or change of building function as a basis for the competent authority or competent officials to issue construction permits, repair permits, demolition permits, construction opening permits and new certificate of occupancy.
  3. Certificate of Conformity: refers to the letter issued by the project reviewer and certifier to confirm the conformity of the design project in accordance with the construction technical regulations and other applicable regulations.
  4. Project reviewer and certifier: refers to reviewer and certifier team of the Ministry of Land Management, Urban Planning and Construction, a professional or company with a construction inspection and certification license provided by the Minister of Land Management, Urban Planning and Construction to carry out the work of construction inspection and certification.
  5. Project Designer: refers to a professional or company or government entity that has a project design license or permit issued by the Minister of Land Management, Urban Planning and Construction to carry out the project design work.
  6. The classification, type and size of constructions required for project reviewing and certification are as follows:
    • All types of constructions issued by the Minister of Land Management, Urban Planning and Construction.
    • All types of construction where the construction permit is provided by the Governor of the Capital / Provincial Board of Governors.
  7. Project review and certification can be done voluntarily for the following constructions:
    • Religious buildings for public use issued by the Governor of the Capital / Provincial Board of Governors.
    • All types of construction where the construction permit is provided by the Governor of the Municipal, District, Khan Board of Governors.
  8. The construction owner must enter into a contract to provide construction reviewing and certification services with reviewer and certifier with valid license to carry out the reviewing and certification work of his / her design plan before applying for a construction permit, repairing permit, demolition permit, construction opening permit, and new certification of occupancy.
  9. All costs for reviewing and certifying the project design are the responsibility of the construction owner.
  10. The work of reviewing and certifying the design project shall be carried out on the design project plan which has been done and has not yet received the approval of the competent authority or competent official.
  11. The construction reviewer and certifier shall make a report on the reviewing and certification of the design project and issue a certificate of conformity of the design project to the construction owner.
  12. In case the reviewer and certifier recognize that the design project has any defects or inaccuracies in the form and / or does not comply with the construction technical regulations and other applicable regulations, the reviewer and certifier shall notify to the construction owner to mediate the project designer to adjust and modify plans.
  13. Reviewing and certification of architectural plans for new construction or modification work must be carried out before applying for a construction permit.
  14. Reviewing and certification of architectural plans for changing building functions must be carried out before applying for a new certificate of occupation.
  15. Reviewing and certification of structural design plan for new construction work, modification work and demolition work must be carried out before applying for a construction site opening permit.
  16. Reviewing and confirming the structural design plan for changing building functions must be carried out before applying for a new certificate of occupancy.
  17. The construction reviewer and certifier shall submit the report on the structural calcuation in digital form or hard copy to the construction owner to complete the application for construction opening permit, repairing permit, or new certificate of occupancy.
